Op-Ed on the Sumal judgment (C-882/19)

Miguel Sousa Ferro writes in EU LAW Live commenting on the Sumal judgment (C-882/19) that the judgment clarifies essential points, such as the regime of liability for breach of Article 101 TFEU being governed directly by European Union law, the homogeneity of liability in public and private enforcement and the liability of subsidiaries for infringements by the parent company. Nonetheless, it raises broader doubts about the concept of the economic unit and will create legal uncertainty in many other areas of competition law.
